These Terms of Service (the “Terms”) together with any policies referenced herein describe your rights and responsibilities when you use the Services.

When you place an order, you make an offer to purchase. NOMADchef may accept or decline your order at its discretion. Your order is accepted when we confirm acceptance and process your payment. Please review orders carefully before submitting; cancellations may not be possible once accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

You represent and warrant that your purchases are for your own personal or household use and not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time of order and shown in your confirmation email. Unless expressly stated, prices exclude taxes, shipping, handling, customs, and import charges.

Prices in our online store may differ from prices elsewhere. Promotions may be governed by separate terms; if there’s a conflict, the promotion terms apply.

You agree to provide current, complete, and accurate purchase and account information and to promptly update it (including email, payment method, and billing details) so we can complete transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorised to use it; (iii) charges will be honoured by your payment provider; and (iv) you will pay all charges at posted prices, including shipping/handling and applicable taxes.

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. The Services (including trademarks, text, images, graphics, video, audio, reviews, and their design/arrangement) are owned by NOMADchef or its licensors and protected by applicable laws. You may use the Services for personal, non-commercial use only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works, publicly display, perform, republish, download, store, or transmit any material from the Services without prior written consent.

NOMADchef names, logos, product and service names, designs, and slogans are trademarks of NOMADchef or its affiliates/licensors. Shopify names and marks are trademarks of Shopify. Other names and marks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsement. We have no liability arising from your use of such tools. Your use is at your own risk and subject to the third party’s terms.

The Services may include third-party content or links. We are not responsible for their content or accuracy and are not liable for any harm or damages related to your access or purchases through third-party sites. Review their policies before engaging in any transaction.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

NOMADchef is powered by Shopify, which enables us to provide the Services. Sales and purchases are made directly with NOMADchef. Shopify is not responsible for any aspect of sales between you and NOMADchef. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from your purchases and transactions with NOMADchef.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is governed by our Privacy Policy, and certain data may also be processed under Shopify’s Privacy Policy. By using the Services, you acknowledge these policies. Because the Services are hosted by Shopify, information you submit may be processed by Shopify and service providers (including in other countries) to operate and improve the Services.

If you submit reviews, ideas, suggestions, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose. To the fullest extent permitted by law, in no case shall NOMADchef or Shopify, or their respective affiliates, officers, employees, agents, contractors, service providers, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or any products, even if advised of the possibility.

You agree to indemnify and hold harmless NOMADchef, Shopify, and their affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law or third-party rights, or your use of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted and the remainder shall remain in full force and effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site, form the entire agreement between you and us and supersede prior agreements. Ambiguities shall not be construed against the drafting party.

You and NOMADchef submit to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable consumer protection law in your jurisdiction.
